Penn State Man Charged with Assault at Diner

A 20-year-old man with no permanent address was chased by police through the streets of downtown State College early Saturday before he was tracked down and arrested in connection with an altercation at Ye Olde College Diner, 126 W. College Ave. Avenue.

James Edward Davis Jr. was charged with escape, disorderly conduct, harassment and underage drinking. He was arraigned before district judge Jonathan Grine and committed to Centre County prison in lieu of $15,000 bail.

Police officer H.J. Johnston said in an affidavit that she went to the diner shortly before 2 a.m. Saturday after a caller reported an assault.

When she got there, a victim had been punched once in the back of the head, and the suspect had already left westbound on College Avenue. The suspect was described as a black male wearing a white Allen Iverson jersey and a ball cap.

In the affidavit, Johnston said another officer soon told her someone matching that description was in front of Cafe 210 West. She went there, led the suspect aside, asked him to sit on the ground and was in the process of handcuffing him when he stood up and ran east on College Avenue, according to the affidavit.

Johnston chased him and used her police radio to call for help. The suspect ran south on South Fraser Street and then east on West Calder Way. At least three police cars in the area were flashing emergency lights.

Police apprehended the suspect after ran into a dead end in the 100 block of West Calder Way.
