A toxicology report shows that a Texas Tech student was under the influence of alcohol and marijuana when he was shot to death after entering the home of a stranger this summer.

Ross Baker died in June after being shot by homeowner Charles Mire, who told authorities he feared for his and his family's safety when Baker entered the home and set off an alarm in the middle of the night

A report shows that Baker's blood alcohol content was more than twice the legal limit.

The district attorney's office says that Mire has not bee charged with any crime.

District Attorney Matt Powell says the law allows people to use deadly force in their home if they fear injury or death.
